Victims of human trafficking often face a long and painful road, even after they escape. Many fear being sent back to dangerous situations in their home country. Others worry about their immigration status, safety, and how to protect their families from retaliation.
If you are in the United States because you were trafficked (for sex or labor) and you are helping or willing to help law enforcement, you may be eligible for a T visa.
To qualify, you must show that:
- You were a victim of severe trafficking, involving force, fraud, or coercion.
- You are in the U.S. (or a U.S. territory or port of entry) because of that trafficking.
- You have helped law enforcement, or are exempt due to age or trauma.
- Being forced to leave the U.S. would cause you extreme hardship or serious harm.
- You are admissible to the U.S. or can qualify for a waiver.
If approved, a T visa allows you to stay in the U.S. for up to four years, work legally, and apply for a green card. You may also be able to bring certain family members, especially if they are at risk of retaliation because of your escape or cooperation with authorities.
