Seeking asylum in the United States can be a lifeline, but the requirements are strict and the process is complex. Missing a deadline or misunderstanding the rules can put your future at risk.
To qualify for asylum, you must meet the following criteria:
- You entered the U.S. within the last year (some exceptions apply).
- You’ve experienced persecution, or face serious danger, in your home country.
- That persecution must be based on your political opinion, religion, race, nationality, or membership in a particular social group.
- You have a well-founded fear of persecution if forced to return.
We help people apply for both types of asylum:
- Affirmative asylum . For those not in removal proceedings, typically filed within one year of entering the U.S.
- Defensive asylum. For those already in immigration court, used as a defense against deportation.
Even if you’re unsure whether you qualify, we can help you understand your options. The laws are complex, but you don’t have to face them alone.
